The Dillon City passed the second reading of Ordinance 10-14 [an ordinance amending Title 5, Chapter 1 (Building Regulation and Code Enforcement), Section 5-1-23 (Homeowners May Perform Work in Primary Residence) of the City of Dillon Code of Ordinances] at their December meeting.
The ordinance reads as follows:
NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Dillon, that Title 5, Chapter 1 (Building Regulation and Code Enforcement), Section 5-1-23 (Homeowners may perform work in primary residence) of the City of Dillon Code of Ordinances is hereby amended so that the provisions shall read as follows:
Section I. Section 5-1-23 (Homeowners may perform work in primary residence).
(a) State Law requires residential construction to be done by licensed residential builders and specialty contractors. Construction must comply with all applicable state laws, building codes, zoning regulations and local municipal ordinances.
(b) Individual homeowners are allowed to perform work in their primary residence with immediate family members provided that a permit is obtained. No business license is required of the homeowner provided they do all of the work themselves or with immediate family members who is not defined by South Carolina state laws as contractors or registered entities or individuals.
(c) Immediate family members shall hereby be defined as wife, husband, mother, father, sister, brother, son, daughter, mother-in-law, father-in-law, son-in-law, daughter-in-law, grandmother, grandfather, grandson, granddaughter, stepmother, stepfather, stepson, and stepdaughter.
(d) Nothing in this section may be construed to authorize an owner of a residential building or structure to hire a person or entity that is not licensed ore registered in accordance with the provisions of the Code of Laws of South Carolina.
Section II. BE IT FURTHERED ORDAINED that all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent necessary to give the provisions of this ordinance full force and effect.
Section III. BE IT FURTHER ORDAINED that if any of the provisions of this ordinance shall be deemed unenforceable or invalid, then the remainder of the provisions herein shall not be affected thereby and the same shall remain in full force and effect. The Council of the City of Dillon hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause and provision herein, even without the section(s), subsection(s), sentence(s), clause(s), or provision(s) that are held to be enforceable or invalid.
Section IV. BE IT FURTHER ORDAINED that this ordinance shall be in full force and effect from and after the earliest date permitted by law.
